EVERGREEN MEMBERSHIP SUBSCRIPTION TERMS & CONDITIONS
Plymouth Argyle Football Club ("the Club")
These Evergreen Membership Subscription Terms & Conditions ("Terms") apply to the purchase and use of all Evergreen Memberships issued by Plymouth Argyle Football Club.
By purchasing or renewing an Evergreen Membership, the Purchaser and Member agree to be bound by these Terms, together with the Club's Ground Regulations, Conditions of Entry, Privacy Policy and any other applicable Club policies published from time to time.
Definitions
For the purposes of these Terms:
Annual Renewal Date means the date on which the Membership automatically renews for the following Membership Year. Unless otherwise notified by the Club, this will be the day following the Club's final home league fixture of each Season.
Club means Plymouth Argyle Football Club.
Conditions of Entry means the rules, regulations and conditions governing admission to Home Park as issued by FIFA, UEFA, The FA, the EFL and the Club.
Date of Commencement means the date on which the Club accepts payment and activates the Membership.
Fortress means the Club's appointed membership and payment platform provider.
Ground means Home Park Stadium or any alternative venue used by the Club.
Ground Regulations means the stadium regulations published by the Club.
Junior means any individual who is under the age of 18 years on 31 July immediately preceding the relevant Season.
Member means the individual registered to an Evergreen Membership.
Membership means an Evergreen Membership issued by the Club.
Membership Benefits means the benefits applicable to the Membership tier as published by the Club.
Membership Fee means the annual subscription fee.
Membership Year means the period between one Annual Renewal Date and the next.
Purchaser means the individual purchasing the Membership.
Reward Credit means a non-cash promotional loyalty credit awarded to eligible Members through the Evergreen Rewards Programme.
Season means the relevant football season.
Website means www.pafc.co.uk.
Membership Categories
The Club may offer Evergreen Membership in the following categories:
Junior Memberships (for individuals under the age of 18 years on 31 July immediately preceding the relevant Season):
- Junior Standard Membership
- Junior Premium Membership
Adult Memberships (for individuals aged 18 years or over on 31 July immediately preceding the relevant Season):
- Adult Standard Membership
- Adult Premium Membership
Where a Member reaches the age of 18 after 31 July, they shall remain eligible for the applicable Junior Membership until the end of that Membership Year. Adult Membership pricing and benefits will apply upon the next Annual Renewal Date.
The Club reserves the right to request proof of age at any time and may refuse or amend a Membership where incorrect information has been provided.
Membership Benefits
Membership Benefits vary depending upon the Membership tier purchased.
Benefits may include:
- Priority ticket access
- Exclusive member pricing
- Retail offers
- Competitions and prize draws
- Digital content
- Events
- Partner offers
- Merchandise benefits
- Other benefits published by the Club
Membership does not guarantee ticket availability for any fixture.
Priority access does not guarantee the ability to purchase tickets.
The Club reserves the right to introduce ticket ballots or allocation limits for high-demand fixtures.
Unless otherwise stated, Membership discounts, Reward Credits and promotional offers cannot be used in conjunction with any other offer, discount or promotion.
Membership Benefits are non-transferable and have no cash value unless expressly stated.
Premium Membership Replica Shirt Benefit
Where applicable, Premium Members are entitled to receive one official replica shirt voucher during each eligible Membership Year.
The voucher:
- is valid only against full-price official replica home shirts;
- cannot be exchanged for cash;
- cannot be transferred;
- is subject to stock availability;
- must be redeemed within the validity period specified by the Club.
The Club reserves the right to amend this benefit from time to time.
Evergreen Rewards
Eligible Premium Members and eligible Season Ticket Holders may participate in the Evergreen Rewards Programme.
The Evergreen Rewards Programme is administered through Fortress.
The Club reserves the right to amend the operation of the programme where reasonably necessary.
Reward Credit
Eligible Members will receive Reward Credit at the rate applicable to their Membership tier, as published by the Club from time to time. The applicable Reward Credit rate forms part of the Membership Benefits associated with each Membership tier and may differ between Membership categories.
Reward Credit:
- has no cash value;
- cannot be exchanged for cash;
- cannot be withdrawn;
- cannot be transferred;
- cannot be sold;
- cannot be assigned;
- cannot be gifted.
Reward Credit is a promotional Membership benefit only. It does not constitute cash, electronic money, stored value or any form of property belonging to the Member.
Reward Credit will be credited to the Member's Fortress account following settlement of an eligible transaction.
Eligible Purchases
Reward Credit may only be redeemed against purchases made directly from Plymouth Argyle Football Club including:
- Club-operated food and beverage outlets;
- Official Club Retail Store;
- Official Club Online Store.
Reward Credit cannot be earned or redeemed against:
- Gift cards;
- Gift vouchers;
- Discounted merchandise;
- Promotional products;
- Membership purchases;
- Membership renewals;
- Season Ticket purchases or renewals;
- Cash withdrawals;
- Third-party purchases;
- Third-party concessions;
- Products excluded by the Club from time to time.
Merchandise Returns
Where Reward Credit has been awarded on a purchase that is subsequently refunded, cancelled or exchanged, the Club reserves the right to deduct the corresponding Reward Credit from the Member's Fortress account.
Where a purchase is partially refunded, the Club reserves the right to reduce Reward Credit proportionately.
Schedule of Benefits
The Membership Benefits applicable to each Membership tier are contained within Schedule 1, which forms part of these Terms.
Automatic Redemption
Reward Credit will automatically be applied against the Member's next eligible purchase.
Members cannot elect to:
- retain Reward Credit;
- delay redemption;
- bank Reward Credit;
- defer or manually retain Reward Credit beyond its automatic redemption.
Where the available Reward Credit exceeds the value of the qualifying purchase, only the amount required for that transaction will be redeemed. Any remaining Reward Credit will remain on the Member's account and be automatically applied to the next eligible purchase, provided the Membership remains active.
Membership Continuity
Where a Member's Membership expires, is cancelled, lapses due to failed payment, is terminated by the Club or is not renewed, any unused Reward Credit shall immediately expire and cannot be reinstated.
Where a Member subsequently purchases a new Membership following such expiry or lapse, Reward Credit will recommence from zero.
This does not apply where the Member:
- upgrades from one Evergreen Membership tier to another (including Standard to Premium); or
- transitions from a Junior Membership to the applicable Adult Membership upon becoming eligible.
In these circumstances, any unused Reward Credit will transfer to the Member's new Evergreen Membership, provided there is no break in Membership.
Reward Credit remains available only whilst Membership remains active and continuous.
Fraud and Misuse
The Club reserves the right to:
- remove Reward Credit awarded in error;
- reverse Reward Credit where transactions are refunded;
- suspend Reward Credit;
- terminate Membership where fraud or abuse is suspected.
The Club's decision shall be final.
The Club reserves the right to apply annual or transaction-based limits to the amount of Reward Credit that may be earned.
Membership Fee and Payment
Evergreen Membership is sold as an annual subscription.
Membership Fees are published by the Club and may be amended prior to each Membership Year.
By purchasing Membership, the Purchaser authorises the Club to securely retain payment details and automatically collect future Membership Fees.
Payment will be taken using the payment card held on file unless updated by the Member before renewal.
The Club accepts debit and credit card payments.
Automatic Renewal
Membership automatically renews on each Annual Renewal Date.
The Club will provide Members with at least 14 days' notice before collecting the automatic renewal payment.
Unless cancelled before the Annual Renewal Date, the applicable Membership Fee will automatically be charged using the stored payment method.
Member Information
Members are responsible for ensuring that their:
- email address;
- postal address;
- telephone number;
- payment details;
- remain accurate throughout their Membership.
Right to Refuse Membership
The Club reserves the right, at its absolute discretion, to refuse or cancel any application for Membership or renewal of Membership.
Cancellation
Members may cancel their Evergreen Membership at any time by notifying the Club.
Cancellation will prevent future automatic renewals but will not entitle the Member to a refund of any Membership Fee already paid unless required by law.
Where Membership is cancelled before the Annual Renewal Date, Membership Benefits shall continue until the expiry of the current Membership Year.
Failed Payments
If payment cannot be collected:
- the Club may attempt payment again;
- Membership Benefits may be suspended;
- Reward Credit may become unavailable;
- Membership may ultimately be cancelled.
Members will be contacted following a failed payment before their membership is cancelled.
Cooling-Off Period
Members purchasing online have a statutory 14-day cooling-off period.
If Membership Benefits have already been used during this period, the Club reserves the right to make an appropriate deduction where permitted by law.
To exercise the cooling-off right, Members should contact the Club using the contact details published on the Club's Website.
Membership Cards
Membership credentials may be issued digitally or physically.
All Membership credentials remain the property of the Club.
The Club may suspend or withdraw credentials where these Terms are breached.
Transfer
Memberships are personal.
Memberships may not be transferred, sold or assigned without the prior written consent of the Club.
Changes to Membership
The Club reserves the right to amend:
- Membership Benefits;
- Membership categories;
- Membership pricing;
- Reward Credit rules;
- eligible purchases;
- excluded products;
- operating procedures.
Where reasonably practicable, Members will receive advance notice of material changes.
Suspension and Termination
The Club may suspend or terminate Membership where:
- payment is outstanding;
- these Terms are breached;
- fraud is suspected;
- Membership credentials are misused;
- behaviour brings the Club into disrepute;
- operational or legal requirements make termination necessary.
Membership accounts, Membership Cards and digital credentials must not be shared with any other person. The Club reserves the right to suspend or terminate Membership where misuse is suspected.
Termination results in the immediate loss of all Membership Benefits, including any unused Reward Credit.
Force Majeure
The Club shall not be liable where Membership Benefits cannot be delivered due to circumstances beyond its reasonable control, including severe weather, government restrictions, industrial action, stadium closures, pandemics, utility failures or other force majeure events.
Liability
Nothing in these Terms limits liability for death or personal injury caused by negligence.
Subject to applicable law, the Club shall not be liable for:
- indirect losses;
- loss of business;
- loss of profits;
- travel or accommodation costs;
- technical failures of third-party systems, including Fortress;
- cancellation or amendment of fixtures, events or benefits outside the Club's reasonable control.
Data Protection
The Club will process personal information in accordance with UK GDPR, the Data Protection Act 2018 and the Club's Privacy Policy.
Club Communications
The Club may communicate Membership information by email, SMS, mobile application notifications or other electronic means.
Prize Draws
Eligible Members may be entered into prize draws and competitions.
Prize draws are subject to separate competition terms where applicable.
The Club reserves the right to amend or withdraw prize draws.
Safeguarding
The Club operates safeguarding procedures for all Junior Members.
Certain Membership Benefits may be restricted according to age.
Privacy
By participating in the Evergreen Rewards Programme, Members acknowledge that relevant purchase data may be processed by the Club and/or Fortress for the purpose of administering Membership Benefits.
General
The Club's failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
If any provision is held to be invalid or unenforceable, the remaining provisions shall continue in full force.
These Terms constitute the entire agreement between the Club and the Member regarding Evergreen Membership.
These Terms shall be governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Important Information
Membership Benefits are reviewed annually and may change between Membership Years.
The latest Membership Benefits, pricing and promotional offers are published on the Club's official website.
Members should familiarise themselves with the current Membership Benefits before each Annual Renewal Date.
